The short version
Evatin is a tool for running a coaching or consulting practice. You own everything you put into it. Eva reads your records to help you and can be wrong, so check before you act. If you ask her to join a call, it's on you to tell the other person first. You can leave whenever you like, take your data with you, and delete the rest. We'll keep it running well, tell you before anything important changes, and answer when you email.
The rest of this page says the same things carefully enough to be an agreement.
Who's who
- "Evatin", "we", "us" and "our" mean Evatin, based in Australia: the other party to this agreement.
- "You" and "your" mean the person who created the account. Evatin is built for one person running their own practice, and an account belongs to one person.
- "The service" means the app at evatin.com, this website, and everything they do, including Eva.
- "Eva" means the assistant inside Evatin.
- "Your content" means everything you put into Evatin and everything Eva produces from it: your leads, clients, notes, tasks, files, business profile, call transcripts, and your conversations with her.
These terms and the privacy policy together are the whole agreement between us. The privacy policy explains what Evatin stores and who else touches it; this page explains what we each agree to do.
Your account
- You must be at least 18 and creating the account for your own business or practice. Evatin isn't for personal use or for anyone under 18.
- An account is for one person. Don't share your sign-in, and don't create an account for someone else.
- You're responsible for what happens under your account. Keep your password safe, and tell us at once if you think someone else has got in.
- Keep your email address current. It's how you get back in if you lose your password, and how we reach you about anything that matters.
- Give us accurate information when you sign up and keep it accurate.
Plans, prices and payment
Evatin has a free plan, a trial, and paid plans. Which plan you're on and what it includes are shown in the app, and prices are shown before you pay.
Allowances
Every plan includes a monthly allowance of call recording time and, on some plans, of messages to Eva. The allowances are shown in the app and you're warned as you approach them. When one runs out, that feature waits until the allowance resets or you move to a plan with more; nothing you've stored is touched. Leads, clients, tasks, notes, the calendar, reminders and briefings are included on every plan without limit.
Trial
A new account may include a trial of the paid features. No card is needed to start it, it doesn't renew, and when it ends the account moves to the free plan on its own. Nothing is charged unless you choose a paid plan.
Paying
- Paid plans are billed monthly in advance, in the currency shown at checkout, and renew automatically until you cancel.
- Payments are taken by Stripe. Your card details go to Stripe directly and are never seen or stored by Evatin.
- Prices shown include any tax that applies unless the checkout says otherwise.
- If a payment fails we'll let you know and retry. If it still can't be taken after a reasonable period, the account moves to the free plan. Nothing you've stored is deleted for non-payment.
Cancelling and refunds
You can cancel a paid plan at any time from the app. It stays active until the end of the period you've paid for and then moves to the free plan; it isn't renewed after that. We don't refund the unused part of a month, except where the service has been unavailable for a substantial part of it, where the law requires it, or where we think it's the fair thing to do. Ask.
Price changes
We can change the price of a plan for new subscribers at any time. The price you subscribed at will not go up while you stay subscribed. If a plan's allowances change in a way that gives you less, we'll give you at least 30 days' notice and you can cancel before it takes effect.
Recording calls
Evatin can send Eva into a video call to record it and produce a transcript. She only joins when you ask her to, and she appears as a visible participant with a name. This is the one part of Evatin that touches someone other than you, so it comes with responsibilities that are yours:
- Tell the other people on the call before Eva joins, and don't record anyone who objects. In most Australian states every party to a private conversation has to consent to it being recorded, not just the person recording, and the law where the other person is may say the same or more. Eva appearing in the participant list is a backstop, not consent.
- You're responsible for knowing and following the recording and privacy laws that apply to you and to the people you speak with, wherever they are.
- You're responsible for how you use a transcript afterwards, including anything you share from it.
We're not a party to your calls and we don't listen to them. Recording is done by Recall.ai, which deletes the audio and video 48 hours after the call; the transcript is kept in your account under your control. The privacy policy has the detail.
If you use Evatin to record a call unlawfully, that is a breach of these terms, and you're responsible for the consequences.
Your content
You own your content. All of it, including what Eva writes from it. We claim no rights over it.
To run Evatin we need permission to store it, show it back to you, send the relevant parts to the services that make Evatin work, and let Eva read it. You give us that permission, for those purposes only, for as long as your content is in Evatin. We don't use your content to train Eva or any other model, we don't sell it, and we don't share it beyond the services named in the privacy policy.
Your content will usually include information about other people: your leads and clients. You're responsible for it. That means you have the right to keep it in Evatin, you've told those people what they need to be told under the privacy law that applies to you, and you'll deal with any request they make about it. We hold their information only to run Evatin for you and we act on it only on your instructions.
You also confirm that your content doesn't break any law or anyone's rights, and that it isn't anything described under acceptable use.
Eva and what she produces
Eva is built on a large language model. She reads your records and your calls, and she writes things from them: briefings, tasks, notes, a read of how a call went. She's good at it, and she's sometimes wrong. She can misread a call, miss a detail, or state something plainly that was only implied.
- Check before you act. Anything Eva produces is a draft for you to confirm, not a fact you can rely on without looking. Everything she writes is editable, and every action she proposes waits for your yes.
- She isn't professional advice. Nothing Eva says is legal, financial, medical, or any other regulated advice, and it isn't a substitute for your own judgement about your clients.
- Eva's output is generated from your content and is yours. Because a language model can produce similar text for similar input, we can't promise it's unique to you.
- Don't try to get Eva to produce anything you couldn't lawfully produce yourself, and don't use her to make decisions about people that the law says a person has to make.
Acceptable use
Use Evatin to run your practice. Don't:
- break the law with it, or put content in it that's unlawful, defamatory, or infringes someone's rights;
- record people without the consent the law requires;
- use it to harass, deceive or harm anyone;
- try to get into anyone else's account or data, probe or interfere with the service's security, or overload it;
- copy, resell, sublicense or offer the service to other people, or build a competing product by scraping it;
- reverse-engineer it, or use automated means to extract data beyond the export the app gives you;
- work around plan allowances;
- put in anything you don't have the right to, including someone else's confidential information.
If you do, we can suspend or end your account. We'll tell you why, and where it's practical we'll warn you first.
Other people's services
Evatin works alongside things you already use. Your calls happen on Zoom, Google Meet or Microsoft Teams under your own account and their terms. Your browser delivers notifications. The services that run Evatin behind the scenes are listed in the privacy policy. We're not responsible for those services, for changes they make, or for what they do with your data outside what we've sent them on your behalf, though we choose them carefully and we'll tell you if one changes in a way that matters.
Availability and changes to the service
- We aim to keep Evatin up all the time, and we don't promise it. It can go down for maintenance, because a service it depends on has gone down, or because something broke. We'll fix it as fast as we can.
- Evatin will change. We'll add things, improve things, and sometimes remove or rework something. If we remove something you rely on, we'll give you reasonable notice and a way to get any data it held out first.
- We can set and change fair-use and technical limits, such as file sizes or the length of a single recording, to keep the service working for everyone.
Ending the agreement
You can leave at any time
Settings lets you export everything and delete your account. Deletion is immediate and permanent: your records, files, transcripts, conversations with Eva and your sign-in are removed straight away. Take the export first if you want a copy. If you're on a paid plan, deleting the account ends it; there's no refund for the rest of the month beyond what the refunds section says.
We can end it too
- For a breach of these terms, as described under acceptable use.
- If we have to by law.
- If we stop running Evatin. If that ever happens we'll give you at least 30 days' notice and keep the export working for that whole time, so nothing of yours is lost.
When the agreement ends, your right to use Evatin ends, and your content is handled as the privacy policy describes. The parts of these terms that by their nature should survive, such as ownership, liability and disputes, do.
Ownership
Evatin, Eva, their names, code, design and everything that makes them work are ours and stay ours. These terms give you the right to use the service; they don't give you any ownership in it. If you send us feedback or ideas, we can use them to improve Evatin without owing you anything, and without that changing who owns your content.
Warranties and liability
First, what the law guarantees. If you're a consumer under the Australian Consumer Law, you have guarantees that can't be excluded: among them, that a service will be provided with due care and skill and be fit for its purpose. Nothing in these terms takes those away. Where the law lets us limit what we do about a failure of one of those guarantees, we limit it to supplying the service again or paying the cost of having it supplied again. Similar rules may apply where you live if you're outside Australia, and nothing here takes those away either.
Beyond that, Evatin is provided as it is. To the extent the law allows, we don't promise it will be uninterrupted, error-free, secure against every threat, or that Eva will be accurate, and we exclude every other warranty and condition, whether written here or implied.
What we're not responsible for, to the extent the law allows:
- indirect or consequential loss, lost profit, lost business, lost clients, or loss of reputation;
- loss caused by relying on something Eva produced without checking it;
- the consequences of recording someone without the consent the law requires;
- loss of data you could have exported and didn't, or data you deleted;
- anything caused by a service outside our control, by your own equipment or connection, or by something you did in breach of these terms.
A cap. To the extent the law allows, our total liability to you for everything arising out of this agreement, in any twelve-month period, is limited to the amount you paid us in that period, or AUD 100 if you paid nothing. This cap doesn't apply where the law doesn't let it, including the consumer guarantees above, or to anything we do deliberately or fraudulently.
Your responsibility to us
If someone brings a claim against us because of your content, because you recorded a call without the consent the law required, or because you broke these terms, you'll cover the reasonable costs and any amounts we have to pay as a result. We'll tell you about any such claim promptly and won't settle it without talking to you.
Changes to these terms
These terms will change as Evatin grows. Small clarifications get made quietly and the date at the top moves. If the change matters, such as a change to what you pay for, what we're responsible for, or what we can do with your content, we'll tell you in advance by email or in the app, and you'll be asked to agree to the new version the next time you open Evatin. If you don't agree, you can export your data and delete your account before the change takes effect, and we'll refund any unused part of a paid period.
Each version is dated. The app keeps a record of which version you agreed to and when, so there's never a question about what you were shown.
Law and disputes
This agreement is governed by the laws of Australia, and any dispute belongs in the courts of Australia. Nothing in that stops you relying on consumer protections in the country where you live.
If something goes wrong, email us first. Almost everything can be sorted out in a conversation. We'll reply within a few days and try to resolve it with you before either of us involves anyone else.
If any part of these terms turns out to be unenforceable, the rest still applies. If we don't enforce something straight away, we haven't given it up. You can't transfer this agreement to someone else; we can transfer it if Evatin is ever sold or moved to another entity set up to run it, and we'll tell you if that happens.
